Terms of Service

Welcome to Smart Wrestler. These Terms of Service ("Terms") govern your access to and use of the Smart Wrestler platform, including our website, mobile applications, and related services (collectively, the "Service").

1. Acceptance of Terms

By creating an account or using the Service, you agree to be bound by these Terms, our Privacy Policy, and any additional terms applicable to specific features of the Service. If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18 years old, you must have permission from a parent or legal guardian to use the Service. Users under 13 years old require verifiable parental consent in compliance with the Children's Online Privacy Protection Act (COPPA).

3. Account Registration

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

4. User Roles and Responsibilities

The Service provides different roles with varying permissions:

• Athletes/Wrestlers: Register for tournaments, view brackets, track performance
• Parents/Guardians: Manage minor athlete accounts, provide consents, receive notifications
• Coaches: Manage team rosters, register athletes, access team statistics
• Tournament Administrators: Create and manage tournaments, handle registrations

You agree to use the Service only for its intended purposes and in compliance with all applicable laws and regulations.

5. Tournament Registration and Fees

When registering for tournaments through the Service:

• Registration fees are determined by tournament organizers
• All fees are processed through our payment processor, Stripe
• The tournament organizer is the seller of record for entry fees. Entry fee payments are collected into the organizer's own Stripe account. Smart Wrestler is a technology provider that facilitates the transaction and collects a separate service fee; we do not hold, owe, or control the organizer's entry fee proceeds.
• Refund policies are set, published, and honoured by individual tournament organizers. Refund requests must be directed to the organizer of the event you registered for, and any refund is issued from the organizer's account. Smart Wrestler cannot compel an organizer to issue a refund.
• Where a refund is issued, card processing fees charged by Stripe are not returned by Stripe and may not form part of the refunded amount.
• Registration is not confirmed until payment is successfully processed. Until then no entry exists, and an incomplete or abandoned payment leaves no registration on record.
• A fully refunded registration is released: the entry is withdrawn from the roster, weigh-ins, and brackets, and the wrestler may register again if the event still has capacity.

6. Liability Waivers and Medical Consent

Participation in wrestling events involves inherent risks. By registering for tournaments through the Service:

• You acknowledge the physical nature of wrestling and associated risks
• Parents/guardians must sign liability waivers for minor athletes
• Medical consent forms may be required for emergency treatment
• Tournament organizers may have additional requirements

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Smart Wrestler and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. User Content

You may be able to submit content to the Service (e.g., profile information, photos). You retain ownership of your content but grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content in connection with the Service.

9. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Impersonate any person or entity
• Interfere with or disrupt the Service
• Attempt to gain unauthorized access to the Service
• Collect user information without consent
• Upload malicious code or content
• Harass, abuse, or harm other users

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

IN NO EVENT SHALL SMART WRESTLER, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
